I bought a counterfeit N95 8G at ebay.

I bought a counterfeit N95 8G at ebay. What should I do now. Can I get my money back. I did ask it's a real Nokia N95 8G and has GPS and Wi-Fi before the auction. He said "yes" . When the phone arrive, It turn out was a fake N95 8G

Welcome to the forums.!

First, have you contacted the seller to let him know your findings? How do you know its a clone.? What does it say on the screen when you enter *#0000# ?

Check out my blog below to make sure.

If your not getting any response from the seller, file a claim that the item received is nothing like the item advertised, and state that its an counterfeit item.

How did you pay for this handset?

If you paid via paypal with your credit card, or debt card, you maybe able to get your full money back.

Contact your bank, and make them aware also that you have been conned into buying a counterfeit item, which was advertised as genuine.

Do you have a link to the eBay auction site for us to take a look at ?

Also, could you get some photos of the handset, and post them up on here? Im researching clones, and if you checkout my signature, you can see, Im doing all I can to make people aware of these counterfeit handsets, in the hope they don't fall prey to the counterfeiters.

The phone does not has GPS and Wi-Fi,a and the camera is only 640x480 resolution. ( I guess it's 0.3 megapixel??) I paid it via paypay. here is the link.

1. Note that he sold an identical phone previously... And his ad said "This phone is from China"... This wording has been removed in his recent ad, along with a give-away pic!

2. The fact that his ad said "Comes with computer cord and 2gb micro SD card by Sandisk", is a strong warning sign, as the Genuine Nokia N95-8GB doesn't have a memory-card expansion-slot.

3. As the item was described as a Nokia N95-8GB, then supplying a clone is obviously fraudulent practice, therefore you have a very strong case for a full refund.

Have you notified the seller that it's a fake and if so, what was his response?

To anyone else reading this... Please take note of my sig and post info on here before buying a Nokia N95 on ebay... Many of us know what tell-tale signs of a fake to look for!

Definitely file a claim with PayPal - assuming you used them for payment? They will open a dispute to which the seller will be able to respond (which you should see also). They will allow you to try and resolve the issue between yourselves initially but they will step in where necessary.
