Battery problems

I recently purchased an new battery for my n95 phone as the old one wasnt keeping a charge. Ive replaced the battery & the problem is still there, after a full charge it will only last a couple of hours.

After reading a post about simular problems I decided to give the info a go which was in the post & have now discovered that the volume button on the side is missing from under the case.

Could this missing button be causing my battery to drain so quickly
