I think i did it!! lol! followed this link
Change Product Code in Nokia 5800 which for a novice i found very easy to follow and picked a new product code off the list on here with confirmed new fw/ currently 9mb out of 137mb updated so could be here a while yet.

that would have been easier! lol.. booked marked that link just incase! Just relieved to be on the new FW now.. kinetic scrolling is a godsend! Touch seems more responsive to.
